Terms and Conditions:
This 5-Year All-Weather Limited Warranty (the “All-Weather Warranty”)
provides additional warranty coverage to the original purchaser on the items
listed in Section E2 of the 5-Year Limited Manufacturer’s Warranty, which is
included in SunSetter Products’ owner’s manual (the “Manufacturer’s
Warranty”). Under this All-Weather Warranty, except as specifically set forth
herein, SunSetter Products will repair or replace any damaged parts covered by
this All-Weather Warranty, regardless of whether the product is defective or
whether the damages occurred due to weather conditions, or any other reason,
without the prorated coverage set forth in Section E1 in the Manufacturer’s
Warranty. If the purchaser has purchased an accessories coverage, SunSetter
Products will repair or replace any damaged awning
accessory (defined as accessory attached to the awning) purchased from this date
forward under the same terms as those described above. After the first year,
this All-Weather Warranty does not cover any damage to the vinyl fabrics.
However, the purchaser may purchase, for any reason, a replacement 9 ft.
projection fabric for $99.00 (reg. $299.00) or a 10 ft. 2 in. projection fabric
for $149.00 (reg. $349.00).
ANY FAILURE TO COMPLY WITH THE REQUIREMENTS SET FORTH IN SECTIONS B, D (OTHER
THAN D2), F1, F4, F5, F7 AND G OF THE MANUFACTURER'S WARRANTY,
WHICH ARE INCORPORATED HEREIN BY REFERENCE, WILL NULLIFY THIS ALL -
WEATHER WARRANTY AND RELIEVE SUNSETTER PRODUCTS FROM ANY RESPONSIBILITY OR
LIABILITY UNDER THIS ALL - WEATHER WARRANTY.
We recommend that the product be installed, maintained,
operated, used, and stored in accordance with the instructions contained in the
owner’s manual and purchaser must not leave the product open in high winds or
let water pool on the fabric.
THE WARRANTY GRANTED HEREIN IS THE EXCLUSIVE REMEDY FOR THE PURCHASER.
SUNSETTER PRODUCTS MAKES NO OTHER WARRANTIES TO THE PURCHASER, EXPRESS,
STATUTORY, IMPLIED OR OTHERWISE AND ALL IMPLIED WARRANTIES, INCLUDING
WITHOUT LIMITATIONS, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. TO THE EXTENT PERMITTED BY LAW,
SUNSETTER PRODUCTS SHALL HAVE NO LIABILITY TO THE PURCHASER OR ANY OTHER PERSON
FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES OF ANY KIND
OR NATURE WHATSOEVER, WHETHER ARISING OUT OF BREACH OF WARRANTY OR OTHER BREACH
OF CONTRACT, NEGLIGENCE OR OTHER TORT, OR OTHERWISE, EVEN IF SUNSETTER PRODUCTS
SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH POTENTIAL LOSS
OR DAMAGE. IN NO EVENT SHALL SUNSETTER PRODUCTS BE LIABLE FOR LOSS OF PROFITS
AND/OR WAGES.
